These Terms of Use (“Terms”) constitute a legally binding agreement made by and between A Mighty Practice and the user of this Site (personally and, if applicable, on behalf of the entity for whom you are using the Site; collectively, “you”).
A Mighty Practice Member Policies
Upon purchase of any Christine Garvey Studios Inc (DBA A Mighty Practice) digital workshop, membership plan, or coaching program, the purchaser agrees to the following company policies. We reserve the right to make changes to any of our policies at any time. As a user of the website you are agreeing to these policies and any future revisions during your membership term. As a company, we will do our best to inform our users of any adjustments made, however it is ultimately the responsibility of the purchaser to be aware and comprehend the following policies.
Upon purchase of A Mighty Practice Coaching Program you recognize that coaching does not equate to mental health services or professional counseling. As a participant in coaching, you accept that your coach is not held responsible for any outcomes related to your mental health and that you will seek out the guidance of a mental health professional in the event that you should need one.
Cancellation Policy: Upon purchase of A Mighty Practice Coaching Program the purchaser is agreeing to pay the total sum of the 3 month membership in equal monthly installments, billed automatically each month on the same calendar date post purchase. A coaching program member may cancel their membership within the first 72 hours of enrollment for a $50 cancellation fee. After 72 hours the member is committed to the remaining payments on their membership and may either maintain the membership monthly payment plan or complete the owed amount as one payment via ACH transfer.
A Workshop Membership participant may cancel their membership themselves at any time from their dashboard or by writing in to customer support and requesting cancellation.
All a la carte purchases are final sale.
Refund Policy: We do not provide refunds for the Coaching Program unless requested in 48 hours. We do not provide refunds for previous months of the Workshop Membership, even if the member has not logged in. We do not provide refunds for a la carte workshops even if the purchaser did not log in during their access time to view the content. If there is an issue with billing, it is the responsibility of the purchaser to alert the company of the error and maintain awareness of transactions posting to their account. A Mighty Practice maintains the right to refuse refund even if the transaction was completed in error.
Annual workshop memberships are eligible for a refund minus transaction fees upon request within the 30 days of purchase or renewal. After 30 days, members are ineligible for a refund.
Plan Expiration Policy: Upon expiration of any A Mighty Practice subscription your access will end without contact or action needed from the member. The Coaching program is not set to auto renew.
Plan Extension Policy: There is no option to extend or add access time to any A Mighty Practice plans, including coaching memberships & all a la carte purchases. There are no exceptions made to this policy.
Option to Freeze Policy: There is no option to pause or freeze any A Mighty Practice plans, including the Workshop Memberships, Coaching Program & all a la carte purchases.
Billing Policy: If you are a Workshop Member and have a failed payment, the system will retry the charge up to 4 times before cancelling your plan. A Smart Retry system is used to determine optimal times for payment retries but typically these attempts are all processed w/in a week. After the 4th failed billing attempt your plan will be canceled.
If you are a Coaching Program member and have a failed payment, the system will attempt again 3 days later, 8 days later, and 15 days later. If your payment fails on the 15th day your plan will be cancelled and access will end.
We do not have the ability to reinstate cancelled plans and the member will be responsible for purchasing the plan again. The member will be subject to the current rate and previous discount codes or plan rates may not be available.
Discount Code Policy: A Mighty Practice reserves the right to cancel or refuse any discount code at any time without notice. If a customer forgets to use a discount code at purchase, A Mighty Practice reserves the right to refuse to retroactively apply any discount code.
Legacy Member Policy: There are no tiered discounts offered to customers who own lifetime access a la carte workshops.
Upgrade Policy: If a customer purchases the Workshop Membership and decides they would rather join the Coaching Program, they may cancel and be granted a full refund within three days of their registration. After three days there are no refunds granted on workshops and it is advised that the member wait until the access time is done to sign up for the Coaching Program.
Marketing Content Policy: Upon purchase of A Mighty Practice Workshop membership the purchaser understands and agrees that group workshops may be recorded and used for future use, and that class or group images may be used in future marketing content.
Intellectual Copyright policy: All content is the intellectual property of Christine Garvey and Christine Garvey Studios Inc (DBA A Mighty Practice). Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, course material, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to Christine Garvey Studios Inc and A Mighty Practice, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.
The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. No part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.
As Is Policy: Upon purchase of any A Mighty Practice Workshop or Coaching plan, the consumer is agreeing to the purchased content as is and there are no guaranteed upgrades or improvements. The company reserves the right to update & alter the existing content and sell these upgraded versions separately.
BY ACCESSING, USING ANY PART OF THE WEBSITE OR SERVICES AND/OR PURCHASING ACCESS TO ANY A Mighty Practice ONLINE CLASSES or PROGRAMS (“ONLINE CLASSES OR PROGRAMS”), YOU AGREE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS, WHICH CONTAIN LIABILITY LIMITATIONS. YOU ALSO AGREE THAT YOU ARE 18 YEARS OF AGE OR OLDER. IF YOU DO NOT AGREE TO BE SO BOUND, YOU MAY NOT ACCESS OR USE THE WEBSITE OR ANY SERVICES.
